न्यू योर्क, अमेरिकाको न्यू योर्क स्थित युनाईटेड शेर्पा एसोसिएसन (शेर्पा किदुग) ले शेर्पा समुदाय बिच संबिधान सुझाबबारे एक छलफल कार्यक्रम सम्पन्न गरेको छ।

कर्यक्रमलाई लिखित र मौखिक गरि दुई भागमा बिभाजन गरिएको थियो। लिखित शुझाबहरु ब्यक्त गर्नेहरुमा शेर्पा किदुगका भु पु अध्यक्ष छेवाङ लामा, पासाङ दोर्चि शेर्पा (यु यस नेपाल मेडिया सेन्टर), बेल्जियमबाट जाङ्बु शेर्पाले पठाएका शुझाबहरु बाचन गरिएको थियो भने मौ सुझाब ब्यक्त गर्नेहरुमा लुम्बिनि बिकास कोषका भु पु सदस्य सचिब आङ दावा शेर्पा, पासाङ खम्बाचे शेर्पा, उर्गेन शेर्पा र दानु लामा थिए।

उक्त अबसरमा पासाङ खाम्बाचे शेर्पाले दोहोरो नागारिकता, जनजाति पार्टि खोल्नु पर्ने तथा जन निर्बाचित पदाधिकरिले २ पल्ट मात्र एउटै पदको लागि चुनाबमा भाग लिन पाउनु पर्ने सुझाब पेश गरेका थिए भने दानु लामा र उर्गेन शेर्पाले संबिधान सुझाब संकलन प्रकृया बारे औल्याएका थिए।

यस्तै गरेर आङ दावा शेर्पाले बौद्ध दशर्नलाई संसार भरि फैलाउनु पर्ने, बौद्ध बिश्व बिद्धालय स्थापना गर्नु पर्ने, शैक्षिक शुधार गर्नु पर्ने, नेपालको झण्डामा सगरमाथा अंकित हुनु पर्ने, दैध नागारिकताको ब्यबस्था हुनु पर्ने, नेपालको नाम संघिय लोकतान्तृक हिमालि गणतन्त्र नेपाल हुनु पर्ने तथा आत्मानिर्णयको अधिकार दिदा मुलुक बिखन्डन तिर जाने खतरा हुने भएकोले यस्तो अधिकारलाई केन्दृकृत गरिनु पर्छ भन्ने धारणा राख्नु भएको थियो।

यस्तै गरेर यस कार्यक्रममा नेपाल शेर्पा संघका उपाध्यक्ष आङ दामि शेर्पा, लाक्पा शेर्पा, किदुकका महासचिब ल्हाक्पा गेलु शेर्पा, यु यस नेपाल अनलाईनका प्रधान सम्पादक प्रदिप थापा, यु यस नेपाल अनलाईनका फोटोग्राफर तथा किदुगका सदस्य आङकामि शेर्पा, गोम्बा शेर्पा,आङ डेन्डि शेर्पा, जनजाति महासङका अध्यक्ष कर्मा ग्याल्जेन शेर्पा, आङ ग्याल्जेन शेर्पा तथा बिभिन्न शेर्पा ब्यक्तित्वहरुको उपस्थिति रहेको थियो।

शेर्पा समुदायको तर्फबाट अझ ब्यापक रुपमा संबिधान सुझाब संकलन गरि संबन्धित निकायामा प्रभाबकारि ढंगले पुर्याउनका लागि यहि शुक्रबार अपृल १७ तरिख सम्ममा सुझाबहरु संकलन गर्ने गरि किदुगले एक समितिसमेत गठन गरेको छ।

सो समितिका सदस्यहरु यस प्रकार छन्:

यस कार्यक्रमको सभापतित्व किदुगका अध्यक्ष छोङबा शेर्पाले गरेका थिए भने कार्यक्रम सन्चालन युयस नेपाल मेडिया सेन्टरका अध्यक्ष पासाङ दोर्चि शेर्पाले गरेका थिए। लिखित रुपमा ब्यक्त गरिएका संबिधान सुझाबहरु यस प्रकार थिए।

मेरा  केही सुझाव हरु निम्न अनुसार छन:

१ . कुनै अपराधिक गतिविधि मा लागेको व्यक्ति नेपालको सरकारमा जान नपाउने ( निर्वाचन लड़न नपाउने )

२. विधार्थी राजनीति पूर्ण निषेध गर्नु पर्ने !

३ . देशको मह्त्वपूर्ण ओहोदा मा बसेका व्यक्ति हरु ( विशेष गरि मंत्री हरु ) अनौपचारिक रुपमा   अन्य देशको दुतावासमा (  नियोग , निवाश ) गई देश र जनताको निति निर्माण को गोप्य  छलफल गर्न नपाइने !

४. सम्बंधित क्षेत्र का विज्ञ हरु लाइ मात्र  सोही अनुशारको जिम्मेवारी बहन गर्न दिने !

५. चुनाव को प्रचार प्रशार गर्दा रेडियो , टी,भी, पत्र पत्रिका पोस्टर, पम्फलेट  वा अन्य बिधुतीय संचार माध्यम बाहेक अन्य तरीका ले चुनावको प्रचार प्रशार गर्न नपाउने !

६ . कोशी र टनकपुर जस्ता वा अन्य  महत्वपूर्ण  संधि हरु  गर्दा जनता बाट बहुमतको  समर्थन जुटाउनु पर्ने !

७ . कुनै पनि  पिछ्डीएक, जाती जनजाति हरुलाई  कथित माथिल्लो जाती वा प्रहरी प्रशाशन बाट  जातीय आधारमा  गरिने भेदभाव र मानवीय अपराध  हरु लाइ कानून को कडा घेरमा ल्याउने !

८. मानव तस्कर , मानव अंग व्यापार र चेली बेटी बेच बिखन लाइ  कानून को कडा घेरमा ल्याउने !

९. आतंक वाद , देश द्रोह वा रास्ट्र घात सम्बन्धी कडा कानून ल्याउने !

१०. गाई , गोरु काट्दा  लाग्ने कानून  हटाउने !

“Oneness in Nepali is the change in the structure of Nepal that must guide our people, our country, our government and our constitution.

“A new Nepal with a new constitution in Nepal” slogan seems to be in the minds of Nepalese living in the country and abroad. The public hope is that “a new Nepal” will be built; peace and prosperity will prevail with writing of a “new constitution”. Let us all hope so.

 

While the need for “a Federal Republic Nepal” seems to be the consent amongst majority, different views on what short of federal structure is fitting for Nepal has been argued by different sectors of the Nepalese societies. While majority of ethnic communities of Nepal (Nepali JanaJaati) are demanding for ethnic or region based federal system, few intellects of Nepali casts communities (Nepali Jaat) argue that ethnic-based federal system will lead to the disintegration of the nation.

However, what all fail or ignore to address is the fact that we are all deeply influenced with our own religious beliefs and cultural traditions. While most of our religious and cultural values are all respectable: we cannot deny that our own faiths of superiority and inferiority amongst us (Nepalese) have created distance between us creating disunity socially, politically and economically. Therefore, JanaJaati can blame Brahmin/Chetries and vise versa, but nothing in Nepal will ever change until all of us reject superiority and inferiority complex mentalities from our own minds poisoned by our religions and traditions. Continuation of thoughts and beliefs in self supremacy is a sure thing to lead disintegration of Nepal sooner or latter.

 

Nepalese citizen of goodwill of all backgrounds must arise without further delay to eradicate our fundamental social problem of racial and ethnic supremacy amongst us. Faith and tradition based discriminations are not only a Jaat and JanaJaati issue. Brahmin/Chetries too are discriminated by other Brahmin/Chetries and likewise members of Janajaati too are discriminated by other members of Janajaaties. Our prejudice amongst us have created a disparity in the standards of equal opportunity, providing some with excessive political, judicial, administrative, social and economic advantage while denying others their rights of a citizen and their dignity. Bias, favoritism, unfairness, inequity and double stander in educations are consequences of our prejudice resulting hopelessness in those discriminated against.

No supreme political, social, religious, academic leaders, political ideologies, religious dominations, government policies, constitutional changes, foreign influences can bring peace, prosperity and security in Nepal in persistence clinging to the doctrine of own racial and ethnic superiority feelings based on own religious and traditional orthodoxy. Therefore, each one of us whatever backgrounds must look honestly at our own feelings of racial and ethnic supremacy with new eyes and with a new determination to build a country, in which the rights of all its citizens are respected and guaranteed. Both people of races and ethnicity must be animated with the spirit of optimism and faith in the eventual realization of oneness amongst us.

 

The call for demand for ethnic and/or region-based federal system in Nepal is the direct result of excessive long prejudice mainly inflected upon the ethnic communities and oppressed races by systems of governments. It is not a call against Brahmin/Chetries or Hindu, but against the system of governing the Nation. Anyone propagandizing the thought that demand for an inclusive government with right to self-determination is JanaJaati against Jaati is either insecure or incapable of seeing broadly. The history of unification of Nepal as one nation itself began with racial domination, discrimination and corruptions .The continual tradition of prejudice by racial supremacy has diseased the country, the system of governing, and worked its evil upon Nepalese societies of al backgrounds, resulting affront to self-dignity a cause of hatred and division amongst her people. To ignore the pains caused by years of domination on each other based on human classification, and not concede to the participation of Nepalese of all backgrounds in all aspects of Nepal’s national and international affairs is to expose the country to physical, moral and spiritual danger. The feeling of All-Nepalese as one needs fostering and grounded in our spirituality and moral commitment.

A national program of education, emphasizing the necessity of equality with values in believing all human alike, and appreciation for cultures other than one's own, and respect for differences would be a most important step toward the elimination of racism to bolster nationalism in Nepali.  Simply, making of a new constitution with pretentious equality inserted only in the paper, intended primarily to save the power in governing the nation, no enduring solution will be found to the disastrous consequences of retaliation to the system of governing by elite few.

 

From the day Nepal was unified born a set of contradictory values. First “Nepalese democracy” was defined by authoritarian principles, then by regime, then by political ideologies, and yet all enshrined prejudice in all aspects of country’s national and foreign affairs. Such self-serving democracies of power-struggles poisoned the mind and heart of the nation and would not be abolished without a bloody Maoist war that nearly destroyed Nepal. The evil mentality of previously failed system of power sharing amongst political gangsters is still visible in Maoist government. A mare power sharing by Maoist ideology with other outdated political ideology has defined yet another “Nepali democracy” for Nepal.

We have been always victims of political ideologies, none master of own idea and owner of own vote. We all have been voting for the ideology, not for a true democracy. We all have been voting for the party, not for the unity. We have been voting for failed leaders and systems, not for accomplishment of country, her peace prosperity and security. A true Nepali democracy can only be defined by citizens of Nepal in which Nepalese of diverse backgrounds live as equal partner of one Nation. Any kind of democracy minus feelings of neglect by the citizens (Jaat or Jaati) of the country is totalitarianisms where by one family, one community, one ideology, one faith and one political party has complete control and outlaws all others.

 

Formidable as is the challenge yet to be met, it can fairly say that no significant progress has taken place in Nepal to eliminate totalitarianisms and racism since the days the authoritarian rule has been defeated. Therefore, all failed and mentally corrupted Nepalese political leaders with outdated mentality of all political parties must surrender the responsibility of well-being of Nepal and Nepalese people to a new generation of leaders who faithfully believes in oneness in Nepali.  To newer generation of descendents of people of casts (Jaat) and opportunists members of ethnic communities (JanaJaati); global history is evidence that multicultural nation cannot be governed with singular faith and supremacy of any kind amongst human being, but with firm faith that all humanity is from the same stock.

Nepal’s peace, prosperity, and even her standing in the international community depend to a great extent on the resolution of oneness in Nepali by rejecting self supremacy amongst Nepali. New generation political and social Nepalese leaders and Nepalese in general must foster genuine regard for each other’s fundamental human and citizen rights in all affairs of the nation. We must do so with our feeling of shared responsibility for the peace, prosperity and security of Nepal by comprehending all human as descendents of same species.

Oneness is the first and foremost change in the structure of Nepal that must guide our people, our country, our government and our constitution.

सम्पुर्ण नेपालिको हितमा संबिधान बनाउँन पर्दा यसरि बनाउँ:

नेपाल  अधिराज्य कसैको पेवा होइन सबै नेपालिहरुको साझा सम्पत्ति हो। नेपाल बहुभाषिक,बहुधार्मिक,बहुसांस्कृतिक,बहुजातिय मुलुक हो।

एकले अर्काको भलो चिताउनु पर्दछ। आदर सम्मान गर्नु पर्दछ। जनताको नाममा जहिले पनि सत्तामा पुगेर सामुहिक स्वार्थ भन्दा ब्यक्तिगत स्वार्थमा नै लिप्त हुने परिपाटिलाई तोड्दै मुलुकको भलो गर्न चाहाने ब्यक्ति,समुह वा पार्टिलाई सहि मुल्यङ्कन गरेर हामि सबै नेपालिहरु अघाडि बड्नु पर्ने आजाको मुख्य आवास्यक्ता हो।

हामि सबैलाई थाहा भएको कुरा हो नेपालमा धेरै पल्ट राजनैतीक परिवर्तन भयो तर हाम्रो अझै सामाजिक र आर्थिक परिवर्तन हुन सकिरहेको छैन । नेपालमा बारम्बार नौटन्की भईरहन्छ पत्तै नपाई राजनीतिक माफियाहरुले जनताहरुलाई झुककाउने गरेकोछ,हाम्रो अधिकारहरुलाई कुन्ठित पार्न खोज्ने प्रतिक्रयाबादी तत्वका मतियारहरु  हाम्रो वरिपरि हम्रै मान्छे भित्रै पनि हुन सक्छन यसर्थ बेलामा नै यस्ता तत्वहरु सँग सजग हुँदै सदियोउं देखी कुन्ठित रहेको हाम्रो हक हित र अधिकारको लागि एक जुट हुन सम्पूर्ण न्ययप्रेमी दाज्यु भाई तथा दिदि बहिनिहरुमा हार्दिक अपिल गर्दछु ।

छोट्करिमा संबिधान को बारेमा भन्नु पर्दा निम्न सुझाबहरु पेश गर्न चाहन्छु:

१ आदिबाशी जनजातिको हक हित र अधिकारको लागि आई  एल ओ १६९ मा पारीत भएका कुराहरु नेपाल सरकारले जती सक्दो चांडो कार्यन्वन गर्नु गराउनु पर्दछ।

२ अदिबासी जनजाति ,दलित,महिला तथा संपुर्ण नेपालि नागरिकको आत्मा निर्णयको अधिकार शुरक्षित हुनु पर्दछ ।

३ नेपालका हरेक नागरिकलाई १२ कक्षा सम्म अनिबार्य रुपमा व्याबहारिक शिक्षा  ,त्यस पछी हरेक युबा हरुलाई अनुशासित बनाउन २ बर्ष अनिबार्य सैनिक तालिम र हरेक नेपालीलाई रोजगारी अनी गरीब जनतालाई नि:शुल्क स्वास्थ्य उपचरको ब्यबस्था हुनु पर्छ ।

४ नेपाल बुद्ध जन्मेको देश भएकोले गर्दा बिश्वमा उदाहरनको लागि शान्ति क्षेत्र घोसणा गर्नु पर्दछ र सैनिकको ब्यबस्था खरेज गरि सो मथि हुंदै अएको खर्च शिक्षा,स्वास्थ्य र आर्थिक् उन्नतिको क्षेत्रमा लाउनु पर्दछ।

५ बैदेसिक सामानको आयत कम गरी भरसक आफ्नै मुलुकको आन्तरिक साधन र स्रोतबाट पुर्याउने कनुन बनाउनु पर्दछ ।

६ नेपालको ठुल ठुला ,ब्यापार उध्योग धन्दा ,ठेक्का पट्टा नेपालीले मात्र गर्न पाउनु पर्दछ।

७  जातिय ,भाषिक र सांस्क्रितिक आधारमा गण राज्य हरुको ब्यबस्था हुनु पर्दछ । तर बहुसंख्यक मानब समुदायबाट अल्पसंख्यकहरुको अधिकार र अस्थित्व हनन हुन नदिनका लागि कडा भन्दा कडा सजाय दिने खाल्को नियम बनाउनु पर्दछ।अहिले सम्म लिम्बुवान ,खम्बुवान ,मगरात आदी बिभिन्न राज्य हरुको बिषयमा प्रसस्त कुरा उठेको तर हिमाली क्षेत्रमा बसोबास गर्ने शेर्पा तथा अन्य हिमाली समुदायको बारेमा तेती धेरै चर्चा नउठेको हुंदा हिमाली भेगमा बसोबास गर्ने नेपाली नागरिकको लागि पनि छुट्टै गण राज्यको ब्यबस्था हुनु पर्दछ ।

८ स्वदेश तथा बिदेशमा रहेका सम्पुर्ण नेपालि जनता द्वारा निर्बाचित ५ बर्सका लागि कार्यकारि अधिकार प्राप्त  प्रधानमन्त्री  वा  राष्ट्रपति मध्ये एक पदको मात्र ब्यबस्था हुनु पर्दछ।  प्रसासनिक तथा फजुल खर्च  कम गर्न मन्त्रिमण्डल ,सभासद ,कर्माचरी ,प्रहरी हरेक  ठाउंमा मान्छे कम र जिम्मेवारी बढी दिएर काम लाउनु पर्दछ ।

९ आदिबाशि जनजातिको साँच्चिकै आत्मनिर्णय कै कुरा गर्ने हो  र राज्यको पुन:संरचना गर्ने हो भने समग्रमा नेपाललाई धर्म निरपेक्ष  शान्ति पृय किराँत राज्य घोषणा गरिनु पर्छ ।किराँतहरु नेपालमा बसोबास गरि शाशन गर्ने पहिलो मानब जाति हुन।नेपालमा मङोलमुलका आदिबाशी जनजातिहरु सबै किराँत हुन। किराँत शब्द राई लिम्बुको मात्र पेवा होईन।(किराँत बारे कसैलाई दुबिधा भएमा ईतिहासकार ईमानसिंङ चेम्जोङ र डा हर्क गुरुङको किताब खोजेर पढ्नु होला।)

१० मुलुकको शुरक्षार्थ मुख्य नाकाहरुलाई यथावत कायम राखी देशको सिमाना वारीपरी अग्लो पर्खाल लाउनु पर्छ।

११ बिदेशमा बस्ने नेपालिहरुको लागि पनि संसदमा केहि सिट छुट्याउनु पर्दछ।
